  • Abstract
    There are disagreements over different interpretations of relevant UNCLOS provisions, the means of resolving the disagreement, and whether there is a need to resolve them. Possible approaches to resolution include legal opinions by international bodies, national regulations, bilateral or regional arrangements, and increased dialogue, CBMs and co-operative efforts. Each has its advantages and disadvantages. The South China Sea process and the Indonesian experience in designating archipelagic sealanes offer some relevant lessons. But certain conditions must exist, such as the political will to settle the issues peacefully, the absence of national legislation on the issues, increased transparency and the willingness to consider the views of all interested parties.
