Abstract
This study aims to prevent the symptoms or problems of transsexual that spread in the Malaysian society nowadays from the perspective of existing legislations. Through researches and writings about these symptoms, authors found that there are a variety of causes or factors contributed to the occurrence of these symptoms as well as negative consequences to indvidual and to society in general. People are generally well aware of the adverse effects of these symptoms, but the total number of those who belonged to the transsexual community is increasing from year to year. This paper will focus on the Malaysian existing legal provisions in tackling this issue. This is a qualitative writing with a doctrinal analysis of primary and secondary sources. Findings by interviewing officials from several Religious Islamic Departments showed no specific laws were adopted to effectively curb the symptoms of transsexual in Malaysia at present for both Muslims and non-Muslims. One of the causes is the religion of the transsexual since the personal law of such a person will be referred to when problems as such arise. The existing laws, be it the civil or syariah laws, need a lot of improvements to tackle such an issue. Results from this study can provide recommendations to overcome this serious problem by not only taking into account the method of solution in the form of law enforcement deterrents but also by referring to various factors (religious, psychological, etc.) that could be used to propose amendments to the provisions of existing law.
