WHETHER THE INTERVETION IN THE CONTENT OF THE CONTRACT CONTRADICTS WITH THE PRINCIPLE OF PACTA SUND SERVANDA

The conditions in the course of drawing up a contract may later change unpredictably. Such emerging developments may cause a difficulty in one party’s fulfillment of material performance or a substantial distortion of the balance between the fulfillments set out at the beginning. It is then a problem whether the content of the contract is intervened is contrary to the principle of pactasundservanda. In this study, it is assessed whether an above-mentioned intervention in the contract contadicts with the legal system in the light of the principle of pactasundservanda.
