AN ANALYSE ABOUT THE CONDITIONS OF DIVORCE BY CON-SENT IN TURKISH LAW

Many people in Turkey sue for divorce by consent. It is a result of the applicabi-lity of the divorce by consent. Therefore, in this study, the conditions of the divorce by consent are examined. Family Law is a book of the Turkish Civil Code. In this book divorce is regulated as a type of termination of the unity of marriage (Art. 161-184 TCC.). Firstly, in this study, the historical development of the divorce by consent is analysed. Then, the concept of divorce by consent, its reasons and its comparison with other general reasons are mentioned. Sub-sequently, the conditions of the divorce by consent are also examined in the light of the decisions of the Turkish Court Of Appeal. Finally, some problems related to procedural law about divorce by consent are also examined.
