This research deals with the relationship of instinct and Sharia in Islamic thinking, and what this relationship suggests is not only in terms of intellectual and cognitive connotations that abound in most of the writings that have been written on the subject, but goes beyond this level of knowledge to another level that has been somewhat absent in Islamic thinking, which is the dimension The methodology offered by this relationship, meaning the capabilities related to employing the innate human capabilities in understanding and rationalizing the legal discourse and mandated rulings, and standing on its goals and objectives, and investing these capabilities also in the process of jurisprudence. Therefore, this study comes to stand on this methodological dimension, ie: How can the concept of instinct be employed and based on it in jurisprudential thinking and understanding the philosophy of rulings and the purposes of Sharia?
