Abstract
Depriation of liberty is regulated in Article 109 of Turkish Criminal Code no. 5237 that gathered various crime type that were regulated in former Turkish Criminal Code no. 765. People have right to choose in terms of staying somewhere and going someplace else. As it was referred in former Criminal Code, Turkish lawmaker protected this right under new Criminal Code and also imposed sanction for breaching it.
