Abstract
Over the years, 5237 numbered Turkish Criminal Code’s Article 301 has determined the borders of freedom of expression in our country. Embedded as Article 159 in 1926, this crime and the approaches within its application has evolved and is still evolving, while being subjected to many important discussions. The article first puts forward the historical process of the crime then the elements of the crime is elaborated. Judgements of Court of Cassation and European Court of Human Rights enrich the elaboration of the elements, whereas there is an evaluation of the elements through Comparative Law as well.
