With the development of private enterprises and the increasing demand of building public infrastructures in China, it is crucial to encourage private enterprises to engage in building and operating infrastructures. The legislation and regulation in this field are still in progress, which makes the owners of private capitals confront risks. Through the case analysis of a sewage treatment plant in South of China, this paper analyzes the risks confronted by private enterprises participating in building public infrastructure through BOT (Build-Operate-Transfer) and the sources of risks and makes suggestions in policies.
