Abstract
The study presents the first attempt to illustrate some of the ongoing problems that patents present for those seeking to standardize in the ICT field. On the one hand, the study illustrates these problems by drawing on patent and international trade disputes surrounding the rollout of wireless technologies. On the other hand, it presents several solutions including the introduction of a more systematic approach to dispute resolution based around ADR (Alternative Dispute Resolution), corresponding changes to dispute handing in international trade disputes.
