  • Abstract
    This paper discusses the concerns raised against a proposed amendment to the Patent Reform Act of 2005. In an effort to redress the perceived imbalance between promoting innovation and protecting the rights of patent holders, the post-grant review system was proposed, which gives the public an opportunity to provide input prior to issuance of a patent. Critics, however, feel that the proposal merely contributes another layer of cost, delay and uncertainty.
