بررسي جايگاه بزه پول‌شويي در كاهش امنيت سرمايه‌گذاري تحت قوانين جمهوري اسلامي ايران

Investigating the position of money laundering in reducing the security of investment under the laws of the Islamic Republic of Iran

امروزه با توسعه و تحولات در حوزة صنايع و تكنولوژي، برخي از دولت‌ها براي گسترش و بسط اين امور در چارچوب كشور خود اقدام به جذب سرمايه‌هاي خارجي در راستاي توسعه‌ي كشور خود مي‌كنند. اين مقاله درصدد پاسخ به اين پرسش‌ها برآمده است كه جرم پول‌شويي تا چه ميزان بر كاهش امنيت سرمايه‌گذاري در يك كشور مؤثر است؟ و سياست جنايي تقنيني جمهوري اسلامي ايران در راستاي جرم پول‌شويي به چه نحو است؟ كه نگارندگان تحقيق با روش تحليلي -توصيفي و كتابخانه‌اي به بررسي واژه‌ي پول‌شويي از ديد قانون و دكترين حقوقي بدين نتيجه رسيده‌اند كه بزه پول‌شويي مي‌تواند خسارات جبران‌ناپذيري را در راستاي به خطر انداختن اقتصاد يك كشور به انجام رساند؛ بنابراين با كاهش امنيت سرمايه‌گذاري، شاهد كاهش توسعه‌ي كشور نيز بوده‌ايم. به همين منظور با در نظر گرفتن قوانين حاكم بر پول‌شويي در كشور جمهوري اسلامي ايران دريافتيم كه قوانين مشخص و واضحي در راستاي امنيت سرمايه‌گذاري و تأثير پول‌شويي بر آن وجود ندارد.

Today, with the developments in the field of industry and technology, some governments to attract and expand these matters within the framework of their country to attract foreign investment for the development of their country. This article seeks to answer the questions: To what extent does the crime of money laundering affect the reduction of investment security in a country? an‎d what is the legislative criminal policy of the Islamic Republic of Iran in relation to the crime of money laundering? The authors of the research using analytical-descriptive method and library study of the word money laundering from the point of view of law and legal doctrine have concluded that the crime of money laundering can cause irreparable damage in order to endanger the economy of a country; Therefore, with the decrease in investment security, we have also witnessed a decrease in the development of the country. For this reason, considering the laws governing money laundering in the Islamic Republic of Iran, we found that there are no clear laws regarding the security of investment and the impact of money laundering on it.
