The Interpretation of Article 265 of Civil Code

The property which anyone gives to another is without consideration, for establishing an obligation or for fulfilment of it. The Article 265 has rejected the first probability. But, we canʹt conclude that, giving property to another is deemed to be for establishing an obligation or fulfilment of it. To this effect, there are different opinions in interpretation of article that we can also see these opinions in judicial decisions. The present article by considering different opinions concludes that giving property to another is presumption of being debtor. So, a person gives property to another ask for the return of it when he proves he is not deptor.
