The Status of Jurisprudencial and Lawful Penalty of Insult and Profanity to the Sacred & Saints of Islam

The crime and felony due to profanity and insult to the Sacred and Saints is one of the significant matters in Islamic juris and societies. The main questions raised in this paper are: "What are the Sacred and Saints?" Is insult or profanity to the Sacred considered a Crime?" and "In case, the sin is realized, what is the punishment?" The main purpose of this paper is to answer these questions. The Sacred things are those cases concerned with respected things and individuals by community such as: The Eleveated Essence, the cleansed leaders, the Holy prophet (pbuh), The Glorious Quran, the holy places and times, the jurist Guardian, the great religious authorities, and the believers and in general the pure and sincere people and the saints, who are qualified with the high human virtues and who must be respected. The author of the article seeks to find out the viewpoints of jurists and lawyers considering the profanity and insult to the sacred and the saints and the related punishment. The sin of insult and profanity to the Sacred and Saints has been regarded under the title of respect to Islamic rites and rituals. Under the Islamic penalty law, in Article 513, this kind of guilt as well as the profanity and insult to the Sacred and the Saints and the Prophet has been explained. This paper proceeds to study the jurisprudencial and lawful aspects of the insult and profanity to the Sacred to clarify various unknown aspects of insult and its consequences.
