Barriers and problems on extradition of fugitive offenders, despite the I.R.I.ʹs Interpol membership

Escaping the scene of crime is the first thing grasping the mind of a criminal. In many cases although legal and police arrangements is applied against the offenders to prevent them escape to other countries and prosecute them legally, but still, the offender, after committing a crime and before being detected, scapes through different ways, to other countries. Government according to legal acts on punishment of the criminals, and also in accordance with thier internal legal systems are to safeguard their community against crime and criminal phenomena of such clans, through the international police organization for criminal acts (Interpol), to prosecute such offenders internationally and do the outmost to extradict them to the country of scene of crime. The Islamic Republic of Iran despite the long term Interpol membership, has not had a sound success in extradition of such fugitives to the country. The main reasons for not being able to achieve this are: 1. Characteristics of internal regulations; 2. Disapproval of the credibility of the final act, for the omission of some paragraphs of act.3 on public penalty; 3. Omission of some cases from Iranian punitive system; 4. incoordination between security, foreign policy and internal judical system, and lack of proper training of agents relevent to the subject, and also lack of coordination and connection in data handling with Interpol General Secretariate.
