Abortion in Pregnancy due to Sexual Crimes in Light of Therapeutic Abortion Act

«سقط درماني» به ختم بارداري، قبل از اين‌كه جنين توانايي ادامه‌ي حيات در خارج از بدن مادر را داشته باشد، به‌منظور محافظت از سلامت مادر يا به دليل بيماري يا نقايص جنين اطلاق مي‌گردد. تحقيقات صورت گرفته در مورد سقط جنين نشان مي‌دهد كه رابطه‌ي مستقيمي بين قانوني ‌بودن سقط جنين و كاهش آمار مرگ‌ و مير زنان ناشي از سقط هاي جنايي وجود دارد اما با تصويب قانون سقط درماني و صدور مجوز در موارد بيماري‌هاي جنيني و مادري تعيين شده كه باعث عسر و حرج مادر مي‌شود تحولي اساسي در زمينه‌ي سقط جنين درماني صورت گرفت. با اين وجود موارد زيادي از بارداري‌هاي ناخواسته است كه به دلايل متعدد در قانون موجود، مورد توجه قانون‌گذار قرار نگرفته است كه ضرورت بررسي ابعاد مختلف قضيه را آشكار مي‌سازد. همچنان‌كه در كشورها رويه‌هاي متفاوتي براي سقط درماني برگزيده شده است لازم است كه قانون‌گذار ما هم با نگرشي نو به مساله‌ي سقط جنين، زنان زيادي را كه قرباني جرايم جنسي شده‌اند تحت حمايت قانوني، بهداشتي و اجتماعي خود قرار دهد.

Therapeutic abortion is referred to the end of pregnancy, before the fetus could maintain living outside the mother’s body in order to protect the motherʹs health, or due to disease or fetal deficiencies. The researches about the abortion show that there is a direct relation between the legality of the abortion and the low death rate of women caused by criminal miscarriages, but with the ratification of the Therapeutic Abortion Act and the issuance of permission in maternal and fetal diseases that would bother the mother, a basic development occurred in the area of therapeutic abortion. Notwithstanding, many cases of unwanted pregnancies have been ignored for various reasons in the current Act and this reveals the necessity for the examination of different dimensions of the issue. As there have been different practices in respect of therapeutic abortion in different countries, now it is the time that our legislature place many women victimized by the sexual crimes under its legal, hygienic and social protection.
