نقض حقوق فلسطيني‌ها در نتيجه ساخت ديوار حايل در نظريه مشورتي ديوان بين‌المللي دادگستري

Violation of Palestinian Rights as a Result of Construction of Segregation Wall in the Advisory Opinion of the International Court of Justice

با وجود مخالفت‌هاي شديدي كه نسبت به تقاضاي صدور راي مشورتي از ديوان بين‌المللي دادگستري در خصوص آثار حقوقي ساخت ديوار، وجود داشت، مجمع عمومي تصميم گرفت در مورد اين پرسش، تقاضاي راي مشورتي كند: «آثار حقوقي ناشي از ساخت ديوار توسط اسراييل در سرزمين اشغالي فلسطين شامل بيت‌المقدس شرقي، با در نظر گرفتن قواعد و اصول حقوق بين‌الملل، از جمله كنوانسيون چهارم 1949 ژنو و قطعنامه‌هاي مرتبط شوراي امنيت و مجمع عمومي سازمان ملل متحد چيست؟». ديوان پس از بررسي تمام دلايل، شبهات، ترديدها و ابهامات، سرانجام پس از احراز صلاحيت، به صدور نظريه مشورتي مبادرت نمود. اگرچه نظريه مشورتي ديوان فاقد ضمانت اجراست و نتوانسته است اسراييل را از نقض قواعد بين‌الملل بازدارد اما آثار مثبت آن را نبايد ناديده انگاشت. ديوان در اين نظريه ضمن تاكيد بر اينكه در نتيجه ساخت ديوار، پاره‌اي از حقوق مهم فلسطيني‌ها نقض مي‌شود، بر قابليت اعمال همزمان حقوق بشر و بشردوستانه و در نتيجه، تعهد اسراييل به رعايت آنها در سرزمين‌هاي اشغالي فلسطين و نيز نكات مهم ديگر تاكيد مي‌كند. در اين مقاله منحصراً به نقض حقوق فلسطيني‌ها در نتيجه ساخت ديوار از نگاه نظريه مشورتي ديوان مي‌پردازيم.

In spite of serious oppositions to the demand for issuance of advisory opinion by the International Court of Justice concerning legal effects of construction of the segregation wall, General Assembly decided to ask for advisory opinion concerning this problem: "Taking into account rules and principles of the International Law including Geneva Fourth Convention (1949) and the relevant resolutions of the Security Council and General Assembly of the UN, what are legal effects of the construction of segregation wall by Israel in the Palestinian occupied land, including Eastern Jerusalem?". Having studied all reasons, suspicions, doubts and ambiguities, the Court issued the advisory opinion. Though the advisory opinion is not protected by sanctions and has not been able to prevent Israel from violating international laws, its positive consequences should not be neglected. While emphasizing the fact that construction of the segregation wall would lead to violation of some Palestinians rights, the Court emphasize the possibility of simultaneous applicability of human and humanitarian rights and commitment of Israel to observe these rights in occupied Palestinian land and other points. In the present article, the author will only discuss violation of Palestinian rights as a result of construction of the separating wall as viewed by the advisory opinion.
