مبناي مسيوليت بيمه‌گر حوادث خودرو در مقايسه با حقوق انگليس

The Foundation of Insurer’s Liability for Vehicle Accidents in Iran and England

حقوقدانان تعهد بيمه‌گر به جبران خسارت حاصل از حوادث خودرو را اثر قرارداد با بيمه‌گذار مي‌دانند و بر اين مبنا مسيوليت بيمه‌گر را تحليل مي‌كنند. به نظر مي‌رسد قرارداد، مبناي ظاهري مسيوليت مدني بيمه‌گر است. مسيوليت او در واقع بر توزيع معقول خسارات استوار شده و قرارداد، وسيله‌اي است براي گردآوري سرمايه لازم به منظور جبران خسارات. تحليل مسيوليت بيمه‌گر بر اين مبنا فهم قانون را آسان و اجراي آن را روان مي‌سازد و از پديدآمدن گره‌هاي ناگشودني جلوگيري مي‌نمايد؛ و چون اين امر سازمان‌يافته و خودگردان است، مي‌توان آن را «سامانه مسيوليت مدني جمعي» ناميد. اين مقاله كوشش مي‌كند دو ديدگاه مزبور را بيان، و اثر هر يك را در موضوع‌هاي درگير نشان دهد و حاصل كار را با حقوق انگليس مقايسه كرده و نتيجه را گزارش نمايد.

The jurists believe that the reparation of vehicle accident damages by insurer is based on contract. They analyze the insurer’s liability on this foundation. But this approach faces some difficulties and contradictions. In our opinion, at least compulsory liability insurance is not founded on contract, but on loss distribution. The contract is only an instrument for collecting the necessary capital for reparation. Resolving problems on this basis becomes easy, and it would make it convenient to understand the law and facilitates its implementation. This liability may be better organized under the term of “Collective Civil Liability System”. This idea avoids irresolvable difficulties. This paper tries to explain the two foundations and set forth their effects on important problems, and to compare its outcome with English Law, and then report the result.
