نظارت شوراي حقوق بشر و تقابل آن با حاكميت دولت ها

Interaction Sovereignty and Supervision of the Human Rights Council in Contrast of Gavernment's Sovereignty

امروزه حاكميت مطلق كه قرن ها مهمترين خصوصيت دولتها بود، تحت تاثير تحولات قرن گذشته، اهميت خود را به سود همكاريهاي بين المللي از دست داده است. همراه با جهاني شدن و اجماع بين المللي در تصميم گيري ها، نقش سازمانهاي بين المللي چشم گيرتر مي شود. از صلاحيت هاي سازمانهاي بين المللي، نظارت است كه ياري دهنده ي اجراي تعهدات بين المللي كشورها از طريق ابزارهاي كنترلي و نظارتي و محدود كننده ي حاكميت دولتهاست، تقابل حاكميت و ابزارهاي نظارتي را ميتوان در شوراي حقوق بشر ملاحظه كرد. در اين شورا، حاكميت كشورها تا حد ممكن در برابر ابزارهاي نظارتي مقاومت نشان داده است تا از اثرگذاري ابزارهاي نظارتي در حيطه ي حاكميت كشورها بكاهد. از ديگر سو، ابزارهاي نظارتي شوراي حقوق بشر به جهت اصل شرمنده سازي، حاكميت دولتها را در جهت همسويي با تعهدات حقوق بشري تحت فشار قرار ميدهد؛ به هر حال، فشارهاي شوراي حقوق بشر هيچ گاه بدون تبعيض نسبت به كشورها اعمال نشده است.

Nowadays, the absolute sovereignty that was the most important character of state has lost its importance to the advantage of international cooperation by developments of last century. The role of international organizations would be more effective by globalization and international consensus decision-makings. One authority of international organizations is supervision, that on the one hand it is helpful for executing the international obligations of states by supervisory and controlling instruments, and on the other hand its restrictive the sovereignty of states. The contrast of sovereignty and supervisory instruments is observable in human rights council. In the human right council, the sovereignty of state has been partly able resist against supervisory instruments in order to reduce the influence of it in state's sphere. Furthermore, supervisory instruments of human rights council in order to states embarrassment put them under pressure by their human rights obligations. But this pressure of human right council never applied to countries without discrimination.
