Abstract :
The New Zealand Maritime Safety Authority (MSA) required vessels clearing port to possess a radio and emergency locator beacon. The requirement was of a purely national character. The Court of Appeal held that it was contrary to international law and beyond the powers of the MSA. The article examines the reasoning of the Court, its contribution to the clarification of port state jurisdiction and the law of the sea.
