Spiritual Rights of Consumers in Islamic Banking Dispute Resolution in Indonesia

The consumer s spiritual rights are a form of syariah compliance, which provides assurance of conformity with syariah principles. The problem is, the existence of consumer spiritual rights has not been given fair attention. Thus, these rights need to be fought. In addition, in the context of Islamic banking dispute resolution in Indonesia, there are still some issues, whether in the field of law, institutions and mechanism. The objective of this study is to introduce the concept of consumer s spiritual rights, to identify existing problems and to propose efforts to be taken to strengthen consumer s spiritual rights in the settlement of Islamic banking disputes. Adopting the legal analysis method based on the doctrinal approach, this study found that efforts to be taken, besides introducing policies, are to introduce other forms, among others, Islamic banking roadmap that uses the legal paradigm from OJK, Constitutional Court Decision and some PERMA for strengthening the relevant institutions, and enhancing the quality of judges, as well as mechanisms for resolving Islamic banking dispute in a fast and efficient manner. With these efforts, it is hope to increase customers’ confidence in Islamic banking to the extent that the system be more successful and help in supporting the establishment of a prosperous society.
