Abstract :
The aim of this article is to propose an alternative method for the studies of constitution. The contradiction that stems from the fact that the intensity of the debates on constitution does not accompany sufficient methodological discussions is what lays the basis for this proposal. Underlying the dialectical method that this study proposes as an alternative to legal positivism employed by mainstream studies of constitution are internal relations philosophy on the one hand and a holistic understanding of social sciences on the other. In this respect this article not only exhibits its own conception of philosophy and of social sciences, it also develops a critique of external relations philosophy as well as the specialized understanding of social sciences that rests on an atomistic-rationalist conception of totality. The model that the article proposes for the studies of constitution builds mainly on the dialectical method that Bertell Ollman has reconstructed through a dialectical reading of Marx s classical works. What informs the main tenets of the proposed method in this article are abstractions such as extension, level of generality and vantage point as well as the dialectical categories such as essence-appearance, identify-difference, quality-quantity, metamorphosis, unity of opposites, contradiction, negation of negation, precondition and result.
