Abstract
This study has been prepared to contribute to discussing related to possibility of giving decision of lack of jurisdiction by judge who must withdraw from case based upon reasons which are shown in art. 34 of Civil Procedure Law No. 6100 and scrutinize the availability of any legal remedy for the decision of high court, which makes the decision of court of first instance definitive judgement with casting vote of member of high court who must withdraw from the cassation review based upon reasons which are shown in mentioned regulation.
