THE TRANSFER OF AGRICULTURAL LANDS BY INHERITANCE

Preventing the disintegration of agricultural land is of great importance in terms of agriculture sector and country economy. The state should prevent the agricultural lands from shrinking. The provisions laid down in the Civil Code No. 4721 for this purpose (CC.art.659-668) did not prevent the disintegration of the agricultural land. Because, these articles were not compulsory legal rules. For this reason, amendment has been made with Code No. 6537 in the Code on Protection of Soil and Land Use numbered 5437 and the provisions of CC.art.659-668 were abolished from the enforcement and replaced with imperative provisions. With these regulations, it is aimed to prevent the shrinkage of agricultural land by shattering.
