Abstract :
Turkish-Swiss law has been greatly influenced by Roman law, especially in the area of law of obligations. The liability is one of the most important issues of not only law of obligations but also all private law. When examining the rules and criterias for the liability in the Turkish Code of Obligations, it will be seen that the basis of these is in Roman law. Many institutions, such as intent, types of negligence such as gross and slight negligence, irresponsibility agreements, the theory of utility, are the origins of Roman law. For better understanding and interpretation of these, Roman law should be examined.
