SUSPENSION OF EXECUTION OF THE DEPORTATION DECISION

Deportation decision is an administrative decision. According to Article 53/3 of Law on Foreigners and International Protection, Foreigner, legal representative or lawyer may appeal against the removal decision to the administrative court within fifteen days as of the date of notification. Same article has also regulated the suspension of deportation decision s execution in two ways. Firstly, not be deported during the judicial appeal period which may not be technically a suspension of execution, and secondly, not be deported in case of resort to the judgement which may be a way of suspension of execution. In this article, it will be analysed the resemblance and distinctness of both with the suspension of execution in administrative law.
