Abstract :
This article discusses the issue of whether human beings may be burdened beyond their ability to bear in Kalam and Fiqh and deals with it in a psychological approach. This study is based on four fundamental factors. The first is the view of Kalam and Fiqh scholars on responsibilities related to the humanbeings conditions that they can afford and not; the second is the approach of forensic psychology about the effect of mental illnesses on criminal responsibility; the third is decisiveness of psychodynamic, environmental, biological, genetic factors on the point of affecting the responsibility; the fourth is the debate starting with the datas of psychology and psychiatry regarding how the people who feel faithful to a religion should see their religious responsibilities. In this study it has been defended that the psychological data must be considered while evaluating the responsibilities of the people who feel faithfulness to a religion, and forensic psychiatry s criterias which are used on defining the competency to stand trial of the people who have mental disorders or not able to understand can shed light on deciding religious responsibilities.
