Abstract :
Foundations are an important institution that has deep roots in the history of İslam and has been intimately interested in İslamic jurists and historians. The presence of different religions and civilizations in different views of which have been observed in many societies, but is one of many new dimension with the Muslims developed institutions. It is possible to find many references in our legal history since the earliest periods about the understanding of the foundations that existed in the life from the beginning with the contributions made to the social solidarity. Feeling that to be beneficial to people and society by producing good work is as old as history of humanity. However continuity and institutionalization of charity were enabled with foundations by means of İslamic civilization. Thus Ali Himmet Berki said that “Foundations are the most beneficent in legal institutions which people can think.In this paper, the contributions to İslamic culture and social life have been dealt with in various forms in terms of the legal and social dimensions of the foundation institution. Foundations, which are basically non-governmental organizations, have occupied an important place in the history of İslam as institutions in which many public services are fulfilled during the society and cultural history. It is possible that foundations are seen in almost every area. For example; prosperity, health, education and ironing out the inequality in income distribution etc. There are many practices which are model from past to present. In this paper, we tried to reveal that we need a new perspective about these.
