Merger policy guidelines for the electric power industry

With the emergence of competition as a major public policy goal, the clear trend toward anticompetitive mergers should be ended. At the root of current policy failure is FERCʹs exclusive focus on transmission access and its mistaken presumption that concentration in generation and distribution are of little importance. The merger guidelines proposed here are intended to stem the merger wave and permit a competitive process to flourish.
