Licensing Agreements: Contracts, the Eclipse of Copyright, and the Promise of Cooperation

The simple days of copyright compliance have ended. Any library that wishes to provide access to electronic products must be prepared for massive change. From a selection decision through end-user training, electronic products require special consideration due to their license agreements, which are pervasive and unavoidable. They affect every aspect of the process. Liberty of contract is not an absolute concept . . . . It is relative to many conditions of time and place and circumstance. The Constitution has not ordained that the forms of business shall be cast in imperishable molds
