ABSTRACT: To analysis thepotentialforintentional killingby leavingact, theact of leavingcanbe dividedinto three categories: 1–upon leavingact2–act leavingpreceded byaffirmativeaction(positive) 3–leaving actispreceded bya contract(obligation). There is no doubtthat thefirstkindcannot beconsidereda murderer. The second is the killer and if there is deliberate killing criteria, one is considered to be deliberate killer, but in third kind,there is dispute and in terms of the criminal law in Iran because of no specific context onecannot be considered an intentional killer. However, in some instances of this kind (not all) because of failure to perform the commitment (or non-observance of the regulations), quitter can be considered guarantee in article 295, note three of the Islamic Penal Code.
