چكيده عربي :
الحمد الله الذي أكرم الإنسان بالعقل وشرفه أن بعث اليه الرسل وأنزل عليه الكتب فيها من العلوم والأخبار ما ليس بوسع الإنسان إدراك كل ما فيها لما تحوي من العلوم الغيبية والأسرار الإلهية في خلقه. الهدف من هذا البحث إبراز أهمية النقل وما يتمتع به من سر علمي قد يخفى كثير منه على العقل، إظهار ما يتمتع به النص من خصائص قدسية وإلهية يجب مراعتها عند النظر في النصوص الشرعية. توضيح الفرق بين ما لا يدركه العقل من النص وفيما يحيله العقل، وتظهر أهمية البحث من خلال أهمية الموضوع المتعلق بالنصوص الشرعية التي تعد ذات الخصائص القدسية المتعلقة بكل العبادات في حياة البشر، العقل المسؤول على التكاليف الشرعية فإذا فُقِد العقل ارتفع التكليف رأساً وعُد فاقده كالبهيمة المهملة لا تكليف عليه. وللبحث إشكاليه تواجهه حيث كثير من المكلفين يعانون من قضية النصوص التي لا تدركها عقولهم ولا تحيط بها أفهامهم، فهي محل إشكال حيث البعض يظن أن الشارع شرع للعباد أمور لا يستطيع العقل فهمها أو إدراكها، حيث اتخذ بعض المغرضين من الجهلة والعلمانيين ذريعة للطعن في الدين، والتشكيك في النصوص الشرعية المتعلقة. ونتج للباحث أن العقل لا يدرك كثير من النصوص الشرعية نتيجة ضعفه وعدم بلوغه إلى المستوى النصي، النصوص الشرعية تحمل أسرارا علمية قد تشكل على العقل وقت ما وتظهر بعد حين، لا تصادم بين العقل السليم والنص الصحيح الصريح.

Praise be to God, who has honored man with reason and his honor by sending him messengers and revealed to him books in them of science and news that a person cannot comprehend all that they contain because of the unseen sciences and divine secrets in his creation. The aim of this research is to highlight the importance of transmission and its scientific secret, many of which may be hidden from the mind, to show the sacred and divine characteristics of the text that must be taken into account when looking at the legal texts. Clarifying the difference between what the mind does not comprehend from the text and what the mind transmits, and the importance of the research appears through the importance of the topic related to the legal texts, which are the sacred characteristics related to all acts of worship in human life, the mind responsible for the legal costs. Do not assign it. The research has a problem that it faces, as many of the taxpayers suffer from the issue of texts that their minds do not comprehend and their understanding does not surround. It is problematic, as some think that the Lawgiver has legislated for the servants matters that reason cannot comprehend or comprehend. and questioning the legal texts related. The researcher concluded that the mind does not realize many of the legal texts as a result of its weakness and failure to reach the textual level.
