چكيده عربي :
تناول موضوع هذه الدراسة بالتعريف جريمة الابادة كجريمة من الجرائم الدولية الاشد خطورة على الكيان البشري، تعرضنا من خلاله الى آراء مختلف فقهاء القانون الدولي كالفقي ه بي لا و جلاسير و لومبواس و رايت و غيرهم الذين حاول كل واحد منهم التعريف بالجريمة الدولية باعتبارها اخلالا بمبادئ سامية للقانون الدولي و عدوانا على مصلحة اساسية للمجتمع الدولي.و قد عد في هذا المضمار الفقيه البولوني الاصل رفائيل لمكن اول من اطل ق مصطل ح اي ابادة الجنس البشري على هذه الجريمة سنة 1945 ، و كيف لا و قد ابتلي الشعب البولوني بلاء شديدا بجريمة الابادة التي سلطها النازيون الالمان على الامة البولندية من خلال افناء و ابادة زها ء سبعة ملايين بولوني خلال الحرب العالمية الثانية.و عدت بذلك هذه الجريمة من امهات الجرائم المرتكبة ضد الانسانية و حظيت بتبني الجمعية 1948 . كما تعرضنا بشيء من الايجا ز ف ي هذ ه الدراس ة /12/ العامة للامم المتحدة لها في 09 المتواضعة الى دوافع هذه الجريمة، الدينية و الاجتماعية و السياسية منها مدعمين عواملها و دوافعه اتلك بشواهد تاريخية متوغلة في القدم و الاخرى ذات صلة باحداث معاصرة، مبرزين بشاعة و فظاعة ما تسببت فيه هذه الجريمة الدولية الشنعاء من مجازر و مآسي من شانها القضاء المبرم على وجو د النوع الانساني على اديم هذه البسيطة.كما تعرضنا في ذات السياق الى ركن جريمة الابادة المادي بشك ل اساس ي و ال ى ركنه االمعنوي، العام و الخاص و كذا ركنها الشرعي، اضافة الى ركنها الدولي الذي يضفي عليه اطابع الجريمة الدولية.و قد حاولنا قدر الامكان الاحاطة و لو بشيء من الايجاز بالآثار الوخيمة التي من شانها افساد النسل و هلاك بني الانسان من جراء هذه الجريمة.
چكيده لاتين :
The subject of this study dealt with the definition of the crime of genocide as one of the international crimes most dangerous to the human entity. In this regard, the Polish jurist Raphael was considered to have enabled the first to launch the term “extermination of the human race” for this crime in 1945, and how not when the Polish people were afflicted with a severe affliction with the crime of genocide that The German Nazis imposed it on the Polish nation through the annihilation and extermination of about seven million Poles during the Second World War. Thus, this crime was considered one of the mothers of crimes against humanity and was adopted by the 1948 Assembly. We also briefly presented in this modest study December 09 to the religious, social and political motives of this crime, including supporting its factors and motives, with historical evidence that goes deep in the past and others related to contemporary events, Highlighting the ugliness and outrageous massacres and tragedies that this heinous international crime has caused that would eliminate the existence of the human race on the perpetuity of this simple. The special and its legal pillar, in addition to its international pillar, which gives it the character of international crime. We have tried, as much as possible, to briefly cover, even with some brevity, the dire effects that would spoil the offspring and destroy human beings as a result of this crime.
