حماية الحريات العامة للافراد في ظل تطبيق نظرية الظروف الاستثناية

In light of the application of the theory of exceptional circumstances, the legislator granted the administration broad powers to confront these circumstances with the aim of protecting public order and achieving the public interest in society. Therefore, the administration may use unusual means that may harm public liberties, the protection of which is guaranteed by constitutions and international covenants, especially in the case of declaring a state of emergency. The siege, the state of emergency, and the exceptional situation, so we tried in this research to show the most important effective guarantees that contribute to protecting the public liberties of individuals from the arbitrariness of the administration in the case of their application of the theory of exceptional circumstances. The most important guarantee for the protection of freedoms in this case is the responsibility of the administration for all its actions, and its subjection to judicial oversight that stands in the way of protecting these freedoms, in addition to the conditions imposed by administrative jurisprudence on the administration in order to apply the theory of exceptional circumstances.
