مدى توافر اركان وشروط المضاربة في صيغة المضاربة المطبقة في التامين الاسلامي ( دراسة تطبيقية على شركة البركة للتكافل)

This research tackles the definition of al-Mudarabah contract and Islamic insurance. It provides a comparative study for the fundamental constituents and conditions of this contract in accordance with Islamic Jurisprudence. It aims at assessing the application of these constituents and conditions in the field of Islamic insurance companies in Jordan. The study shows that there is accuracy in the implication of all of the constituents and for the majority of the conditions of this contract in the field stated. However, the researcher has pointed out the breaches available in some of the conditions of this contract according to the application of these companies. He has suggested suitable solutions for the breach existed. This is in an attempt to achieve an authentication for this application, in order to keep the authenticity of Islamic insurance function and practice. The researcher calls the Islamic insurance companies to undertake the recommended solutions as they are illustrated in this paper and to indicate them in their documents.
