چكيده عربي :
الغرض من هذه الدراسة الفقهية المقارنة هو التعرف على دور القواعد الفقهية في فقه صلاة المريض وطهارته ، وإبراز التطبيقات الفقهية في هذا الصدد ، وبيان الأساليب التي يستخدمها الفقهاء في تدبير الأحكام في الأسئلة التي تفتقر إلى نص محدد. والتي غالبا ما تكون مستخلصة من أحكام الفقه التي كان لها أثر معنوي في الأحكام. وخلصت الدراسة إلى أن القواعد الفقهية كان لها دور كبير في الخلاف بين الفقهاء والأحكام المستنتجة وبنية الأسئلة في طهارة المريض وصلاته ، والعديد من القواعد الفقهية التي تحكم التصور الفقهي للسؤال ، مؤكدة أن بعض الأدوار الفقهية كانت شديدة التأثير. في هذا الجزء مثل القواعد: الصلابة تتطلب سهولة ؛ رفض فرض الشريعة بأعذار ؛ لا ضرر ولا ضرر ، وقواعد التعويض التي يصعب على السؤال الاستغناء عنها.
چكيده لاتين :
The purpose of the present comparative Fiqh study is to identify the role of Fiqh rules pertaining Fiqh of patient's purity and prayer and to highlight the Fiqh applications in that regard and to demonstrate the methods used by the fuqaha in contriving judgments for questions lacking specific text, which mostly were concluded from the Fiqh rules that had a significant effect in the judgments concluded. The study concluded that the Fiqh rules has had a significant part in the disagreement among the fuqaha, judgments inferred, structure of questions regarding patient's purity and prayer, many Fiqh rules govern the Fiqh conceptualization of the question, stressing that some Fiqh roles were very influential in this part such as the rules: hardness mandates easiness; sharia impositions dismiss by excuses; neither harm nor damage, and rules of compensation that a question could hardly dispense of.
