جاء هذا البحث؛ ليتناول موضع ضمان العارية في الفقه الاسلاميّ الحنيف، من حيث المشروعيّة لكل من الضمان والعارية واركانهما وشروطهما، ومن ثمّ بيان حكم ضمان العارية في الفقه الاسلاميّ، وفي القانون المدنيّ الاردنيّ، مع التّرجيح بين الاقوال والتّعليل لهذا التّرجيح. الكلمات المفتاحية: ضمان، العارية، القانون المدنيّ الاردنيّ.
چكيده لاتين :
This research came; To address the position of guaranteeing the naked in the pure Islamic jurisprudence, in terms of the legality of each of the guarantee and the loan, their pillars and conditions, and then clarifying the rule of guaranteeing the naked in Islamic jurisprudence, and in the Jordanian civil law, with a weighting between the words and the reasoning for this weighting.
