Important Legal Differences between Woman and Man

عدالت مهم ترين آرمان و آرزوي بشر از آغاز خلقت تا كنون بوده است. عدالت عرصه هاي گوناگوني دارد؛ اما در اين ميان، عدالت در حقوق متقابل زن و مرد به عنوان دو ركن عالم هستي جايگاهي بس ويژه دارد. زن مظهر جمال و مرد مظهر جلال خداوند مي باشد و هر كدام در نظام آفرينش مقامي خاص و ويژه دارند و هدف هر دو رسيدن به كمال است؛ بدون اين كه بر يكديگر برتري داشته باشند. تفاوت هايي كه در برخي احكام اسلام، بين زن و مرد وجود دارد، شائبه تبعيض و نابرابري را در ذهن برخي، به وجود آورده است . اين تفاوت در حقوق به دليل تفاوت در خلقت، وظايف و نقش هاي آن هاست؛ بدون اين كه تبعيضي در كار باشد. عدالت در حقوق زن و مرد را بايد با در نظر گرفتن مجموعه ي حقوق هر كدام بررسي نمود تا روشن شود كه دين مبين اسلام در وضع حقوق و تكاليف يكي را بر ديگري برتري نداده است.ارث، ديه، قصاص، حق طلاق، حضانت، قضاوت وشهادت از بحث هاي چالش برانگيز در زمينه حقوق زن و مرد در اسلام است.

Justice has been the most important human’s aspiration and desire from the beginning of creation up to now. Justice has various fields, but in the meantime, it has a very special position in mutual rights of woman and man as two pillars of the universe. Woman is the epitome of beauty of God and man is the epitome of glory of God; and each one has special position in the created order; and the goal of both is achieving perfection without their superiority over each other. Differences in some Islamic laws between men and women have caused suspicion of discrimination and inequality in the minds of some. The difference in their rights is due to differences in their creation, duties and roles without any discrimination. Justice on the rights of women and men must be evaluated by considering each set of rights to clarify that Islam in adoptation of rights and obligations does not have the superiority of one over the other. Inheritance, blood money, punishment, divorce, custody, judge and witness are the challenging issues in the field of men and women rights in Islam.
