تبيين مفهوم حقوق شهروندي

در گذشته حكومت ها قائم به يك فرد بود و افراد نمي توانستند در مقابل قوانين حكومتي و نحوه اعمال آنها ايراد چنداني كنند. پس از دوران رنسانس و ورود مقوله دموكراسي، بحث حق مردم بر نحوه حكومتداري نيز مطرح شد. خود اين بحث في حد نفسه تا زماني كه به منصه قانونگذاري (قوه مقننه) و اجرايي (قوه مجريه) و نظارت برآن (قوه قضاييه) نرسد، فائده ي چنداني ندارد و صرفا يك سري مباحث تئوريك است. حقوق شهروندي كه در لاتين civium iura و در انگليسي Citizenship rights و درفرانسه Les droits de citoyenneté به آن اطلاق مي شود، از سري همين مقوله است. حد اعلاي آن اين است كه افراد بتوانند آنها را مطالبه كنند و در صورت عدم انجام آن، محكوميت دولت را به اجراي آن بخواهند. حقوق شهروندي از جهت اينكه حقوق بشر ضمانت اجراهاي بين المللي دارد در مرتبه پايين تري است ولي اين نقطه قوت را دارد كه حقوق شهروندي در بعضي موارد قابليت اقامه دعوا در دادگاه هاي داخلي را دارد. ولي آنچه مهم تر است اين است كه با توجه به ضرب المثل حق گرفتني است نه دادني، مردم را بايد به اين حقوق متوجه كرد تا خود آنها را مطالبه كنند. بنابراين ما در اين تحقيق به تبيين و بررسي حقوق شهروندي مي پردازيم.

In the past, the government had a person and people who could not stand against government laws and how to apply them , After the renaissance and the arrival of democracy , the right people on how governance was also raised . This discussion per se as long as evident as their legislation (legislative ) and executive ( executive ) and supervision ( judiciary ) are not , not much use and is merely a theoretical arguments . Citizenship rights that refers to it in Latint Civium iura and in English Citizenship rights and in France Les droits de citoyenneté , is a series of the same category . The culmination of this is that people can ask for and if the government do not do it, condemning the government wants to implement it. Citizens rights in this respect of the human rights have international guarantees would have been at a lower level. but this have this strong point that in some cases the Citizenship rights have ability to litigation in domesti courts. But what is more important is that according to the proverb right must be get and is not giving. peopl should realize their rights to ask for them. So we in this study explore and examine citizenship right.
