Invesitigating the relationship between citizenship and marriage in Iran’s law

ﻗﺎﻧﻮن ﮐﺸﻮرﻫﺎ ﻧﺴﺒﺖ ﺑﻪ زﻧﺎﻧﯽ ﮐﻪ ﺑﺎ ﻣﺮدان ﺧﺎرﺟﯽ و زﻧﺎن ﺧﺎرﺟﯽ ﮐﻪ ﺑﺎ ﻣﺮدان ﺗﺒﻌﻪ ﻫﻤﺎن ﮐﺸﻮر ازدواج ﻣﯽ ﮐﻨﻨﺪ ﻣﺘﻔﺎوت اﺳﺖ و از ﯾﮏ روش ﺗﺒﻌﯿﺖ ﻧﻤﯽ ﮐﻨﺪ. ﻗﺎﻧﻮن ﻣﺪﻧﯽ اﯾﺮان در ﻣﻮاد 986 و 987 از دو روش ﻣﺘﻔﺎوت ﺗﺒﻌﯿﺖ ﮐﺮده اﺳﺖ. ﻃﺒﻖ ﻣﺎده 976 ق.م. زن ﻏﯿﺮ اﯾﺮاﻧﯽ ﮐﻪ ﺷﻮﻫﺮ اﯾﺮاﻧﯽ اﺧﺘﯿﺎر ﮐﻨﺪ ﺑﻪ ﺗﺎﺑﻌﯿﺖ اﯾﺮان درﻣﯽ آﯾﺪ و ﻫﻤﺎﻧﻨﺪ ﺗﺎﺑﻌﯿﺖ اﮐﺘﺴﺎﺑﯽ از ﺣﻘﻮق و ﺗﮑﺎﻟﯿﻒ ﻣﺮﺑﻮ ﺑﻪ اﺗﺒﺎع ﺑﺮﺧﻮردار ﻣﯽ ﺷﻮﻧﺪ. ﺑﻨﺪ 6اﯾﻦ ﻣﺎده ﺗﺼﺮﯾﺢ ﻣﯽ ﮐﻨﺪ «ﻫﺮ زن ﺗﺒﻌﻪ ﺧﺎرﺟﯽ ﮐﻪ ﺷﻮﻫﺮ اﯾﺮاﻧﯽ اﺧﺘﯿﺎر ﮐﻨﺪ اﯾﺮاﻧﯽ ﻣﺤﺴﻮب ﻣﯽ ﺷﻮد». اﯾﻦ ﺗﺎﺑﻌﯿﺖ ﺑﺎ ﻓﻮت ﯾﺎ ﻃﻼق ﺷﻮﻫﺮ و ﺧﺎرج ﺷﺪن ﻣﺮد از ﺗﺎﺑﻌﯿﺖ اﯾﺮاﻧﯽ ﻧﯿﺰ از ﺑﯿﻦ ﻧﻤﯽ رود.
