The Quranic Purpose of the Treaties System

چكيده بر اساس نظريه اثبات گراي حاكم، تنها هدف در نظام حقوق معاهدات، «نظم» در روابط قراردادي بين المللي است. اين تحليل مبتني بر مبناي اصل «حاكميت اراده كشورها» است كه معاهدات را تنها ابزاري براي سامان بخشيدن به روابط قراردادي (در ادبيات حقوقي منبع تعهد) مي انگارد. در اين انگاره روابط بين المللي به «ثبات» در روابط موجود (نظم ) فروكاسته مي گردد، گرچه نابرابري در داد وستدهاي بين المللي را تصديق كند. اما قرآن كريم كه همواره بر غايت اخلاقي در تمامي سطوح روابط اجتماعي تاكيد دارد، «هدف» نظام حقوق معاهدات را ارزش محور، «نظم عادلانه» توصيف مي كند. زيرا معاهدات در ديدگاه قرآني بنيان حيات جامعه انساني (به زبان حقوقي منبع حقوق) قلمداد مي گردد. بديهي است اين منزلت معاهدات در آموزه هاي آسماني ارتباط وثيقي با ارزش حقوقي عدالت (مقصدي از مقاصد انبيا) را مي طلبد. كليد واژگان: قرآن كريم، هدف حقوقي، نظام حقوق معاهدات، نظريه اثباتي حقوقي، نظم ، نظم عادلانه

Abstract According to the dominant positivist theory, the only objective in the system of treaties is order in international contractual relations. This analysis is based on the principle of ‘the sovereignty of Will of states’ that considers treaties as the means of organizing contractual relations (in the legal literature of the source of commitment) only. In this sense, the value such as international peace is reduced to stability in the existing relationships (order), although it acknowledges inequality in international trade. But the Holy Qur an, which always emphasizes on moral ends at all levels of social relations, describes the goal of the system of treaties as value-centered fair order . Because the treaties in the Quranic perspective are playing the role of foundation in the life of the human community (in the legal language as the source of law). Obviously, this position of treaties in the heavenly doctrines requires a solid relationship with the legal value of justice (which is one of the prophets purposes).
