Islamicization of the principle of contractual freedom with emphasis on Qur anic foundations

چكيده يكي از مهمترين اهداف انقلاب اسلامي ، اسلامي سازي همه بخشهاي نظام و تحقق اسلاميت در همه زمينه هاي اجتماعي است،در اين راستا اسلامي سازي علوم انسانيِ مبتني بر ماترياليست ، همواره مورد تأكيد رهبر معظم انقلاب بوده است به همين سبب اين پژوهش در نظر دارد يك نظريه حقوقي غربي را كه مبتني بر مباني سكولار است را با جايگزيني مباني اسلامي ، تبديل به يك نظريه حقوقي اسلامي نمايد و برآيند جايگزين مباني اسلامي به جاي مباني سكولار را به نمايش گذارد. روش كار بدين شكل است كه ابتدا مباني معرفت شناسي، هستي شناسي،روش شناسي و ... صاحب اين نظريه را استخراج و آنگاه مباني مورد نظر اسلام جايگزين شده است ؛ آنچه از جايگزيني مباني اسلامي به جاي مباني سكولار به دست آمده، حاكي از آن است كه نظريه مزبور با مباني اسلامي اندكي تغيير كرده و قلمرو آن محدودتر مي شود. واژگان كليدي: آزادي قراردادي، علوم انساني، اسلامي سازي

Abstract One of the most important objectives of the Islamic revolution is to Islamacize all parts of the system and the realization of Islam in all social fields. In this regard, the Islamicization of the materialist-based humanities has always been emphasized by the Supreme Leader of the Revolution. Therefore, this research aims to replace a Western legal theory, based on secular foundations, with an Islamic legal theory with Islamic foundations and displays the outcome of replacing Islamic foundations with secular principles. The method of conducting this research is to first extract the foundations of epistemology, ontology, methodology, and so on, and then replace it with the foundations of Islam. As the findings of the research, it has become clear that by replacing secular principles with Islamic foundations, the theory has changed slightly its application domain has become more limited.
