چكيده
قرآن كريم متناسب با اهداف خويش كه تحقق حيات طيبه و عدالت در جامعه و هدايت انسانها به قرب الي الله است ، به نحومعنا داري به مباحث حقوقي پرداخته است . كه چنانچه آنهاخالي از تفسير به رأي وبه صورت صحيحي دريافت شود مي تواند ضمن تبين جلوه اي از راز جامعيت وفرازماني بودن قرآن ، زمينه ساز تحول در دانش حقوق وآراي انديشمندان واصلاح رفتارهاي اجتماعي گردد .
سوال اصلي مقاله شيوه هاي صحيح تفسير حقوقي است كه پاسخ آن مبتني بر تبين چيستي، مباني، روشها،رويكردها و شيوه هاي صحيح دسترسي به مقصود جدي خداوند متعال مي باشد.
تفسير حقوقي با سه رويكرد تحليل آيات حقوقي قرآن؛ نگاه حقوقي به آيات قرآن وكشف نظام حقوقي قرآن با شيوهاي متفاوت ترتيبي ، موضوعي، تطبيقي، وميان رشته اي انجام مي پذيرد.وضمن بهره مندي از ابزار تجربه وعقل برمنبع خطاناپزير وحي تكيه مي نمايد.
راهبردهاي تفسيرحقوقي متناسب با رويكرد ، شيوه ومسأله مورد تفسيرمتفاوت است . ولي جامع ترين راهبرد آن است كه بدون تحميل فرضيه هاي علمي برقرآن ولي باتوجه به يافته هاي بشري، وبانگاه به تمام قرآن بعنوان يك مجموعه و بااستفاده ازروشهاي تفسير ادبي،تحليلي، تاريخي، بنيادي، واصولي -برحسب مورد-به كشف مقصود جدي خداوند متعال پرداخته شود.

Abstract
The Holy Quran has consistently addressed the legal issues in accordance with its predefined goals, which are the realization of a pure life, implementation of justice in society and bringing man closer and nearer to Allah. If the legal issues receive a correct interpretation, it can explain the mystery of the comprehensiveness and immortality of the Qur an. This account in turn can pave the ground for bringing a drastic change in legal system [law] and in scholars’ opinions on improvement of social behaviors. The main question of the article is to determine the correct ways of interpreting the law, which is based on the explanation of the essence, principles, methods, approaches and proper ways of accessing the serious intention of Allah, the Exalted. The legal exegesis of the Quran can be carried out with three approaches: 1. To analyze the Qur anic legal verses; 2. Having a legal look at the Quranic verses and 3. The development of the legal system of the Qur an in different orderly, thematic, comparative, and interdisciplinary manners. This method in addition to utilizing the element of experience and reason, relies on an infallible source which is revelation. The strategies of legal interpretation vary according to the approach, methodology and subject matter of the interpretation. But the most comprehensive strategy in legal interpretation is that one has to take the scientific findings into account without imposing scientific hypotheses to the Quran. Moreover, he has to consider the Quran as a consistent collection [of propositions] and use different literary, analytical, historical, foundational, and intuitive methods to discover what Allah has seriously intended from his words in the Quran.
