نقد و بررسي تفاوت شهادت زن و مرد و دفع شبهه نقض جايگاه اجتماعي زن

A review of the difference between the testimony of men and women and the elimination of doubts on the violation of a woman s social status

چكيده در قرآن كريم به لحاظ نگاه شخصيتي تفاوتي بين زن و مرد قايل نشده است ولي در نگاه جنسيتي يك يخشي از وظايف اجتماعي را براي مرد قرار داده است و يك سري وظايف ديگر براي زن تعريف كرده است كه اين وظايف متناسب با ساختار جسمي و جنسي آنها ديده شده است. از سوي ديگر در بحث شهادت و جايگاه شاهد، شهادت دو زن را معادل شهادت يك مرد دانسته است. تفاوت حكم شهادت اين شبهه را ايجاد كرده است كه از نظر قرآن جايگاه اجتماعي مرد بالاتر از زن بوده است كه شهادت او معادل شهادت دو زن دانسته شده است و اين ارزش انساني زن را دچار نقصان كرده است. در نگاه فقها و قوانين جمهوري اسلامي ايران نيز شهادت زن با استناد به آيات و روايات نصف شهادت مرد قرار داده شده است. وجود اين شبهه و تناقض اوليه ظاهري سبب شد تا اين نوشتار به نقد و بررسي تفاوت شهادت زن و مرد و علل اين تفاوت بپردازد و از سوي ديگر عدم هم‌سويي آن با تفاوت جايگاه اجتماعي زن و مرد را نشان دهد. كليدواژگان: شهادت، زن، مرد، اجتماعي.

Abstract The Holy Qur an does not distinguish between men and women in terms of personality, but in terms of gender, according to the physical and sexual structure of these two groups, specific duties have been prescribed for woman. On the other hand, in the discussion of testimony and bearing witness, in some cases the testimony of two women is equivalent to the testimony of a man. The difference in the verdict of the testimony has given rise to this doubt that the social status of a man, in the Quranic view, is higher than that of a woman whose testimony is equivalent to the testimony of two women, which means a reduction in the human value of woman comparing to her male counterpart. The existence of this doubt motivated the writer to dedicate this paper studying the difference between the testimony of men and women and the causes of this difference. Moreover, to show that there is no close relationship between their position in bearing witness and the social status of men and women. Keywords: Holy Quran, testimony, man and woman, social
