بررسي تطبيقي برخي از قواعد فقهي اهل‌البيت (ع) بر اموال منقول با تكيه‌بر ايران چك

A Comparative Study of the Jurisprudents Rules Ahl al-Bayt (AS) on Movable Property relying on Czech Iran

قواعد فقه فرمول‌هاي فقهي حاكم بر بيش از يك باب فقهي است. قواعد فقه گاه در اموال بكار مي‌رود. اموال بر دودسته است. برخي از اموال منقول مي‌باشند. چك يا ايران چك نوعي سند حامل بانكي است كه از سوي شعب بانك‌هاي ايراني بر عهده شعب ديگر و يا ساير بانك‌ها صادر مي‌شود و از انتقال سريع برخوردار است و در عرف تجاري ايران معمولاً بجاي پول درشت استفاده مي‌شود. ايران چك بر اساس قوانين موضوعه ايران، همانند ساير اسناد و اموال بر اساس حقوق اسلامي و حاكميت قواعد فقه اسلامي صادر، انتشار و حمل‌ونقل و وصول مي‌گردد و در صورت غصب تلف، تصرف غيرمجاز و تصرف مالكانه از قواعد حقوق اسلامي پيروي مي‌نمايد. اما بر مال منقول كدام‌يك از قواعد فقه حاكم است ؟ پژوهش با بررسي برخي از قواعد فقه و تحليل مضمون و محتواي آنان، سعي در كاربرد قواعد فقه اسلام در حوزه حقوق خصوصي و مالكيت اموال منقول، به‌ويژه چك و ايران چك دارد. قواعد فقهي زيادي ازآن‌جهت كه ايران چك مال منقول و سند حامل است حاكميت بر آن دارند. برخي از اين قواعد فقهي بر اساس نتايج تحقيق عبارت‌اند از: قواعد اتلاف، امارت يد و ضمان يد.
