An Efficient Comparison of Intellectual Property rights in Iran (after Islamic Revolution) with the member countries of Berne Convention in Design Area

در مقاله حاضر بخش هايي از قوانين بين المللي حق مالكيت فكري از منظر طراحي صنعتي مطابق با كنوانسيون برن و همچنين تاثير آن در كشور ايران گنجانده شده است. از آنجايي كه فقدان قانون كامل حق مالكيت فكري تاثيرات مخربي را براي طراحان صنعتي به دنبال دارد، باعث شده كه اين رشته اثر بسيار ناملموسي در صنعت ما داشته باشد ، لذا وجود قوانين حق مالكيت فكري ميتواند دانش طراحى كشور ما را در حوزه خلق مصنوعات براي رسيدن به طراحي در مقياس جهاني ياري كند. روش انجام تحقيق در اين مقاله به شيوه كتابخانه اي و شبكه اي است كه از طريق استخراج مقالات ثبت شده دانشگاه بالتيمور و سازمان جهاني مالكيت فكري در اين خصوص و مقايسه تطبيقى آن با قوانين حقوقي حوزه طراحي ايران (پس از انقلاب اسلامى) موضوع را آسيب شناسى مى نمايد كه در نهايت اشاره به لزوم اجراي قوانين مالكيت فكري ايران و حمايت از طراحان ميشود.

In the following article, some of the international rules of Intellectual Property Right in industrial design were depicted which were based on Berne Convention and their effect in Iran. Although this major has been counted as one of the 20th money-making majors in the world (usnews 2018), it has had quite untouchable influence in the country s industry regarding the fact that lack of copy right has got destructive impacts on industrial designers. Thus, the existence of copy right can assist right can assist the country s designing knowledge in manufacturing goods at a global scale. This study enjoys a library research to find the destructive effects of lack of the aforementioned rights on the title by extracting the articles registered at Baltimore University and Intellectual Property global organization and its comparison with legal rules in Iranian design area. Finally, this article indicates the fact that copy right rules ought to be passed and run in the country and the design.
