حذف قسمتي از كار و خطاي آغازين در محاسبۀ هزينۀ واقعي ، بيشترين عوامل ايجاد اختلاف و روش مصالحه و داوري بيشترين كاربرد را در حل اختلافات در پروژه هاي ساختماني دارد

Removing a part of the project and the error in the actual estimation,the most contributing factors,and the method of reconciliation and arbitration,are the most widely used in resolving disputes in construction projects.

جهت كاهش زمان اجرايي پروژه و هزينه هاي افزايش زمان آن،نياز به بررسي و شناخت عوامل افزايش زمان پروژه مي باشد يكي از اين عوامل، اختلافاتي است كه در زمان اجراي پروژه بين كارفرما و پيمانكار رخ مي دهد مي باشد.بررسي ومقايسه روش هاي متداول حل اختلاف در اجراي پروژهاي ساختماني كشور هدف اصلي اين پژوهش مي باشد. اين تحقيق كاربردي بوده است و از نظر ماهيت تحقيق نيز به دليل بررسي روش هاي متداول حل اختلاف در پروژه هاي ساختماني يك تحقيق توصيفي به شمار مي آيد. جامعه اماري در اين پژوهش كليه پيمان كاران، كارشناسان و متخصصين پروژه هاي ساختماني در شهر اهواز بوده است كه تعداد 200 نفر بعنوان حجم نمونه آماري مورد مطالعه قرار گرفته اند. شيوه نمونه گيري هم در اين پژوهش به صورت تصادفي ساده بود. در اين تحقيق براي بررسي و تحليل روش هاي حل متداول اختلاف در پروژه هاي ساختماني از مصاحبه با كارشناسان و متخصصين پروژه و پرسشنامه طراحي شده به وسيله محقق استفاده شده است. براي تجزيه و تحليل اطلاعات بدست آمده از پرسشنامه از آماره توصيفي( ميانگين، ميانه، انحراف معيار استاندارد، نمودار ها، جداول و...) و همچنين آماره هاي استنباطي استفاده شد. نرم افزاري كه براي تجزيه و تحليل اطلاعات در اين پايان نامه استفاده شد SPSS و Excel بود. يافته هاي اين پژوهش نشان داد كه حذف قسمتي از كار با هدف ارجاع آن به پيمانكار ديگر، خطاي آغازين در محاسبۀ هزينۀ واقعي پروژه بيشترين عامل ايجاد اختلاف در پروژه هاي ساختماني در شهر اهواز از ديدگاه كارشناسان و پيمانكاران ساخت و ساز بوده است. همچنين مشخص گرديد كه از روش هاي حل اختلاف در پروژه هاي ساختماني، مصالحه و داوري بيشترين كاربرد را در حل اختلافات ايجاد شده در پروژه هاي ساختماني داشته است.

In order to reduce the time of the project and the costs of increasing its time, it is necessary to examine the factors that increase the time of the project. One of these factors is the differences that occur between the employer and the contractor during the implementation of the project.The main objective of this research was to study and compare the common methods of resolving disputes in the implementation of construction projects in the country. The present research based on the purpose of the research is of operational kind. The nature of the research is also a descriptive study due to the consideration of the usual methods of resolving disputes in construction projects. The statistical population in this study was all contractors, experts and construction project specialists in Ahvaz city, in which 200 individuals were studied as a statistical sample. Sampling method was simple in this research. In this research, an interview with experts and project specialists and a researcher-made questionnaire were used to study and analyze the common solutions to differences in construction projects. To analyze the information obtained from the questionnaire, descriptive statistics (mean, median, standard deviation, charts, tables, etc.) as well as inferential statistics were used. The softwares used for analyzing the information in this thesis were SPSS and Excel. The findings of this study showed that the elimination of part of the work with the aim of referring it to another contractor, the initial error in the calculation of the actual cost of the project and the lack of consideration of the risks associated with the contract are respectively the largest factors causing discrepancy in construction projects in Ahvaz from the point of view Experts and contractors of construction. It was also found that dispute resolution methods in construction projects, compromise and arbitration had the most application in solving disputes created in construction projects.
