بررسي نفقه به عنوان حقوق مالي زن در حقوق ايران و سوئد با رويكرد الگوي سوم

هدف از اين پژوهش بررسي تطبيقي حقوق مالي زن تخصيصا مبحث نفقه در حقوق ايران و سوئد به عنوان يك كشور توسعه يافته و يكي از مظاهر عدالت و تساوي در حقوق بين زن و مرد مي باشد، همچنين سعي مي شود در اين جستار به سوالاتي نظير : ايا نفقه فقط مختص ايران و ساير بلاد اسلامي است؟اشكال وقواعد و مقررات نفقه در كشور هاي غربي به شكل است؟ايا حقوق و تكاليفي كه بواسطه شرع اسلام در قوانين جمهوري اسلامي براي زن و مرد ايجاد شده موجب تبعيض بين انان است؟ پاسخ داده شود. يكي از مسائلي كه به عنوان تبعيض بين زن و مرد مطرح گرديده است روابط حقوقي بين انان است. نفقه يك تعهد يكجانبه بوده و زن در اين زمينه هيچ تكليفي ندارد اما در حقوق بسياري از كشورهاي غربي نظير سوئد، اين امر يك تعهد دو جانبه است و زن نيز مكلف به تامين آن است. برخي در اين باره عنوان كرده اند كه بسياري از قوانين فقهي بين زن و مرد تبعيض آميز است و بايد ايران هم به كنوانسيون حقوق زنان كه هدف آن برابري همه جانبه بين زن و مرد است، بپيوندد. براي روشن شدن واقعيت در اين باره بايد زواياي مختلف آن اعم از حقوق و مسائل مالي و غير مالي بين زن وشوهر مدنظر قرار گرفته شود.كه حقير سعي ميكنيم در اين مقاله به موضوع نفقه به عنوان بخشي مهم از حقوق مالي زوجه بپردازم.

The purpose of this study is a comparative study of women s financial rights - with a focus on alimony – in the law of Iran and Sweden , I also try to ask questions like: Is alimony available only in Iran and other Islamic countries? What are the alimony laws in Western countries? Are the laws imposed on men and women in the Iranian legal system by the religion of Islam discriminatory? . One of the issues raised as discrimination between men and women it is their legal relationship. After marriage , men and women find different rights and responsibilities towards each other. The provision of family expenses in Iranian law , also known as alimony , is a unilateral obligation and the woman has no obligation to provide for family , but in the law of many western countries, such as Sweden, the cost of living is a mutual obligation and women must be involved. Some experts have said that many Islamic laws are discriminatory between men and women, and that Iran should accede to the Convention on the Rights of Women, which aims at full equality between men and women. In order to clarify the truth about this issue, its various angles such as rights and financial and non-financial issues between husband and wife should be examined. In the article, I try to address the issue of alimony as an important part of a wife s financial rights.
