The relationship between ethics and family law

اخلاق به مجموعه‌اي از اصول و ارزش‌ها اشاره دارد كه رفتار انسان‌ها را تنظيم نموده و در صورتي كه بر اساس تعاليم وحي استوار باشد، مي‌تواند در جهت تحقق هدف وجودي انسان گام بردارد. احكام حقوقي در خانواده، تأمين‌كننده حفاظت و امنيت خانواده به عنوان جزئي از جامعه است و موجبات بروز محبت، نظم و استواري خواهد شد. در نظام اخلاقي اسلام، تفاوت‌هاي طبيعي و حقوقي در راستاي نيازها، كمبودها و استعدادهاي انساني مي‌باشد. حقوق كه با هدف تنظيم روابط اجتماعي و نظم در جامعه شكل گرفته است، براي بارور شدن خود و پياده كردن اصول انساني در ارتباطات اجتماعي به اخلاق نياز دارد، زيرا ورود اخلاق به حيطه حقوق نه تنها اهداف علم حقوق را برهم نمي‌زند. بررسي نقش ارزشهاي اخلاقي و قواعد حقوقي به عنوان يكي از اصلي‌ترين عناصر شكل‌دهنده در روابط حقوقي در خانواده محسوب مي‌شود. ما در اين تحقيق بر آن هستيم تا با بيان مفاهيم اخلاق، حقوق، ارزش‌هاي اخلاقي و قواعد حقوقي به ارتباط و تمايز اخلاق و حقوق در حقوق خانواده بپردازيم.

Ethics refers to a set of principles and values which regulates human behavior and if it is based on the teachings of revelation, it can take steps towards the realization of the purpose of human existence. Legal provisions in the family provide protection and security for the family as part of society and it will cause love, order and stability. In the moral system of Islam, there are natural and legal differences in terms of human needs, shortcomings and talents. Law formed with the aim of regulating social relations and order in society, it needs morality to be fertile and to implement human principles in social communication, because the entry of ethics into the field of law not only does not disrupt the goals of jurisprudence. Examining the role of moral values and legal rules is considered as one of the main shaping elements in legal relations in the family. In this research, we seek to address the relationship and distinction between ethics and law in family law by expressing the concepts of ethics, law, moral values and legal rules
