    شرط ضمان در عقد رهن ، از مهمترين مباحث فقهي است كه با توجه به قاعده فقهي (كل رهن فانه غير مضمون)آراء و ديدگاههاي مختلفي از سوي فقها بيان شده است . برخي از فقها قائل به بطلان اين شرط هستند و برخي معتقدند اين شرط خلاف مقتضاي ذات عقد است و برخي هم چنين شرطي را صحيح مي دانند. با توجه به اينكه پژوهش به صورت مروري و نظري است مقاله حاضر با بهره گيري از روش توصيفي تحليلي و مبتني بر روش كتابخانه اي و با استفاده از تحقيقات ، كتب ، اسناد و منابع كتابخانه اي مرتبط در صدد بررسي صحت و بطلان اين نوع شرط با توجه به قاعده فقهي(كل رهن فانه غير مضمون )مي باشد. و درصدد اثبات اين فرضيه هستيم كه: كه ادلۀ مخالفان براي اثبات بطلان اين شرط ضمان در عقد رهن ناكافي است و اين اشتراط با توجه به عمومات و اطلاقات ادله وجوب التزام به شروط، صحيح و التزام به آن واجب است

    The guarantee condition in the mortgage contract is one of the most important jurisprudential issues, which according to the jurisprudential rule (all mortgages are non-guaranteed) different opinions and views have been expressed by jurists. Some jurists believe that this condition is invalid, and some believe that this condition is against the essence of the contract, and some consider such a condition to be valid. Due to the fact that the research is a review and theory, the present article by using the analytical descriptive method based on the library method and by using related researches, books, documents and library resources aims to check the validity and invalidity of this type of condition with Paying attention to the rule of jurisprudence (all mortgaging mortgages are unsecured). And we are trying to prove this hypothesis: that the arguments of the opponents are insufficient to prove the invalidity of this guarantee condition in the mortgage contract, and this requirement is correct and obligatory according to the generality and application of the evidence and the obligation to adhere to the conditions.
