اشخاص حقوقي مي توانند مسئول جبران خسارت باشند. از نظر تحليلي، اشخاص حقوقي نيز مي توانند مسئول عمل ديگري به شمار آيند. اين اشخاص مي توانند مسئول عمل كاركنان و كارگران خويش باشند و اين مسئوليت در حقوق ايران مشمول ماده 12 قانون مسئوليت مدني يعني مسئوليت كارفرما ناشي از عمل كارگر مي باشد. سازمان آتش نشاني نيز از اين قاعده مستثني نيست و در قبال عمل پرسنل خود مسئول است و اين مسئوليت بحث تازه اي ندارد، اما در كتب جديد مسئوليت مدني گاه به نوع ديگر از مسئوليت ناشي از فعل غير مطرح شده است؛ اين مسئوليت، مسئوليت شخص حقوقي ناشي از فعل ارگان اداره كننده مي باشد كه به نظر عده اي مسئوليت خاصي بوده، مشمول مسئوليت كارفرما ناشي از عمل كارگر نيست و تا حدودي موضوع نويني است كه در نه تنها در قوانين ما، بلكه در قوانين بين الملل هم مطالب چنداني درباره ي آن وجود ندارد. در اين مقاله اين موضوع در سازمان آتش نشاني تهران بررسي خواهد شد.
